You have been very patient to date and for that I thank you, please note I
am trying to work with you to resolve this longstanding issue.

 

A report from an independent consult is completely different to a quote for
replacement, and we need this report on file as evidence as to the best
method to rectify the doors. 

 

The independent consultant is from Express Glass and carry out such reports
on a daily basis, they will specify exactly what the issue is and the best
method to rectify, and if that is replacement then this will be specified in
the report.

 

Can you please confirm I can pass on your details to the consultant at
Express Glass to carry out an inspection and report of all of your sliding
doors.

I believe I have been more than patient in this matter.

 

It's totally unacceptable that in the loungeroom with the 3 doors (two
sliding and one fixed), the first door is still often times coming off the
track, when I try to open or close it. Seven contractors came through my
home and they provided their expertise and quotes. Who is this 'independent
consultant' and what will they provide that the other seven haven't?

 

I believe I have plenty of information already for NCAT and the 'wider owner
group' from the large number of emails which have been exchanged.

Appreciate your responses below.

 

As you know we did go to an EGM earlier this year and the owners in
attendance voted unanimously not to proceed with the replacement quotes and
rather the repair option.

 

As you have said, the repair has not been successful to date, however the
quotes for replacement and the visual inspection by others is not enough
evidence to present to the wider owner group that your sliding doors do
require replacement.

 

What we are trying to achieve is an independent consultant report that
identifies exactly what the issue is and the best way to rectify, it must be
in technical terms and evidence needs to be provided by way of the report so
we can then present to the wider owners group.

 

If this is to go to NCAT, they will request additional evidence as well
before they make a decision, we are essentially trying to skip this process
and obtain a report asap so we can move forward.

 

The strata committee will then present that report to the wider owners'
group as evidence on how best to proceed.

 

Can you please confirm if you will provide access to the consultants to
conduct their independent inspectionl.

Good afternoon Craig, 

 

I have met with Ryan and Sarah this afternoon to discuss the matter of your
lounge room balcony doors. 

 

To recap, a number of contractors have already attended and provided quotes
for repair or replacement. These quotes were presented to the wider Owners
Corporation, who voted to engage a company to repair the doors as opposed to
full replacement. These works have been completed, however you are still not
satisfied with the situation. The loungeroom sliding door often comes off
the track because it is very difficult to slide. Basic safety issue.

 

As you know, the Strata Committee has a responsibility to ensure the fair
distribution of building funds, maximising resources and ensuring all
decisions are made in the interests of all owners. As we are fully committed
to ensuring all common property is maintained to high standard, we are
required to empower ourselves with the most relevant technical information
available in order to make decisions regarding this property. In this
matter, I agree, the building's common property must be maintained to a high
standard. After 4 visits, Henry was unfortunately unable to complete the
repairs satisfactorily. 

 

In this respect, we will be engaging an independent consultant to provide an
impartial assessment of the state of your lounge room balcony doors, along
with a plan for rectification. Though we acknowledge you have had many
companies attend to look at the problem, these companies have so far been
instructed to quote on future works, as opposed to solely conduct an
inspection and report on the method to rectify the issue. The companies were
instructed to quote on the present works, not any future works. Each company
recognized the damage of the track and frames during their inspection and
therefore quoted on full replacement asap and not in the future. Each of the
companies quoted for full replacement, except for Henry who offered repairs,
which were written as not long term repairs).

 

The committee is prepared to accept the findings of this report as binding
as to the rectification or replacement of the doors. 

 

Sarah will be in contact to arrange a suitable time for the inspector to
attend. Once the findings are received, the committee will convene to
discuss and present a solution.
