Good Afternoon Committee, 

 

The Managing agent has followed me up with regards to an outcome today.
Would you be happy for me to arrange a teleconference/videoconference
committee meeting in order to discuss and consider this application further
so that everyone is on the same page? 

 

The installation of a reverse cycle split system air conditioner is
considered a minor renovation as long as it doesn't involve structural
changes, or change the external appearance of a lot (special by-law 6).

 

Any renovation approvals (especially minor renovations approvals) are
submitted a letter that stipulates terms and conditions of approval, of
which the Owner is requested to sign and return prior to the works
commencing.

Hi EC, 

 

Thanks for the comments. I would like to be balanced to ensure the unit can
be air conditioned. I do not know the reasons why the internal existing A/C
unit can not be repaired. Can someone help me understand those constraints. 

 

I think the noise issue would be OK, but the adjacent units should have a
say. 

 

I would be concerned about water dripping. External units need a place to
expel water, where would this go in relation to this Unit?

 

>From an aesthetic point of view, if the unit was visible from the street, I
would not be in favour.

 

The exclusive use requiring an EGM would need to be addressed.

 

I believe that the unit would need to sign a deed to be responsible for any
leaks connected to water ingress from the holes cut in the main walls and
any water damage caused by the unit itself.

Please, let's make this simple.  This owner wants A/C so that they or the
tenant can enjoy the apartment.   Yes, it may mean a compressor is installed
on the balcony, however they are extremely quiet and as a non-deluxe,
non-luxury building, we are NOT in a quiet area anyway!

 

Please consider we have more membrane concerns (level 7 west)  than a quiet
compressor for A/C on any balcony.  Dripping water on a balcony?  Consider
again that with rain or humidity the balcony will have water on it, at some
point, anyway.  In that situation, the membrane is the question, not water
flow.

 

Can the members of the Body Corporate please come together and get this
request passed so that the owner/tenant can enjoy their home with the A/C
they are requesting.

I feel like I have been through this 100 times. But hear we go again. 

The balcony is common property. An exclusive use bylaw would be required by
EGM to allow a split system aircon to be installed. (EC cant approve) 

The building has a cooling tower and as such was designed with a cooling
tower recirculating water system HVAC with internal apartment compressor
(not external as they note bellow so not the same as indicated) 

The building waste condensate water is piped from inside the apartment
directly into internal drains not onto balconys some balconies do drain onto
others. Unless their aircon guy has looked at the Hydraulic plans of the
building he would have no idea where it drains to. 

Dripping water onto balcony may cause leaks in the future. 

Vibrations of compressors on the balcony may cause leaks in the future and
complicate membrane repairs on balcony in the future if needed. 

Running gas piping between the external compressor and the internal fan unit
will require penetration between inside and outside by removing bricks
drilling holes etc. A future area for water ingress. 

Noise generated by an external compressor (opposed to one inside the
apartment as it is now) may be transmitted to lower floors. 

We do not have council approval in our original  D/A for  external
compressors. 

External air con units are ugly and not in keeping with the look of the
building. 

Once we have approved one unit a precedent  will be set and they will appear
on all other apartments. 

Costs of GAS and Electricity in the BMC are split by the SMS taking into
account that all apartments use the common use aircon. Will this owner
demand a strata plan of sub division to change there entitlement units as
they dont use building HVAC ? 

I feel for the owner with costs involved but to be fair we are all in the
same boat. If you look around the area there are almost no external aircon
units on balcony's of like buildings. External units are common place in
less prestige buildings sure But we are trying to keep the image of the
building high. 

Many other owners have replaced their air con units at great cost and worked
within the rules I know I have 601 has and 401 has likely there are more.
Elan, Zenith, Horizon, Omnia all have cooling tower systems and not external
air cons banging away into the hot summer night dripping water everywhere.
Almost every building that was constructed after 2000 in this area does.
It's not an Auburn 1980's tower block with an aircon out every balcony. 

That's my 2c im sure i could go on but you get the picture this is a very
bad idea and will bite us in the backside one day.

We have received the email below from the recommended air conditioning
company. The cost of $10K+ is not an option for the owner, especially under
the current economic climate with COVID-19. The owner has already suffered
financial loss due to being unable to lease an un-air condition apartment.

 

The split system that was previously detailed we have had installed in many
strata buildings with no issues and should any arise we would take action to
rectify. Could you please discuss this with the committee as we now have a
tenant who needs air conditioning.

These a/c units are no longer in production. 

A custom made unit will need to be manufactured which has a lead time of
around 8 weeks.

An estimated cost for supply and installation would be $10K - $12K.

If the owner is interested then we can attend site to take the required
measurements.
