Long term we need to come up with a solution here. It needs to be placed
on record that we can not close the roof without a bylaw. Our strata
laws state that common property can not be restricted without a bylaw.
It is also worth nothing that closing the roof, even with a deposit
system will detract from the value of apartments without views. People
use the roof for a number of things. Not just partying. Some
socializing, exercising, fresh air, Just getting out of the a small
apartment, children playing, what ever reason; people made investment
decisions based on there being a common roof facility. I do not believe
removing that access serves the greater good of the apartment owners
within the building.
I also do not believe it would pass a vote at the AGM. 75% of the
apartments within the building do not have a view. They are very
unlikely to vote for there view being restricted.
I also think the point that we will be sued is not valid. We cant be
sued for someone committing malicious damage. It's a criminal act. It's
like saying your going to sue the RTA if you cross at a red light and
get hit by a car. As long as we do everything reasonable to prevent it
a problem.
Dont get me wrong here. I know I wont make any friends by saying this.
My own son was hurt by the glass. But our job here on the EC is to
represent the interests of the owners. Not run our own little agenda's.
. We are here to represent the building owners to preserve their
investments. What we feel personally is irrelevant. It's also very
unfair that a few trouble makes ruin what is a valuable resource.
A bylaw that drops the buildings value is only likely to see us voted
out as EC members next AGM and will serve nothing. There is no need
for knee jerk reactions. Lets discuss it at the meeting next week and
see if we can find a solution that people will accept.
Let's see if a solution can be found. We can all discuss it at next
meeting.
