Good Afternoon Committee,
I would like to clarify the situation with the application for renovations within unit 305/200 William Street as there appears to be some misunderstanding within the correspondence and conversations that have occurred.
Please see attached the emails that have been sent to Paul with regards to the renovation. Both Deborah (my assistant) and myself have also spoken to Paul via telephone to discuss this and advised the same information.
The legislation has changed with the Strata Schemes Management Act 2015 taking affect on the 30th November 2016. With the legislation change came changes and clarification in relation to how renovations were to be managed and approved. https://www.fairtrading.nsw.gov.au/housing-and-property/strata-and-community-living/strata-schemes/renovations
The Strata Scheme have got by-laws in place relating to these changes to the legislation, which provides clarification for all owners/residents in relation to what type of renovations are determined cosmetic, minor and major renovations and how these renovations need to be approved (please refer to Special by-law 5, 6 & 7) of the registered consolidated by-laws for your strata scheme, copy attached.
Under the Strata Schemes Management Act, and in accordance to the by-laws applicable to the strata scheme and NSW Fair Trading, a bathroom renovation that entails waterproofing replacement is deemed a major renovation, and therefore requires a by-law to be specially resolved by the Owners Corporation at a general meeting. For the purpose of major renovations, any Owner may utilise the annexure in the major renovation by-law rather than engaging a strata lawyer to have a by-law drafted and proposed to the Owners Corporation for consideration.
Renovations need to be approved via the proper process, and whilst the Committee may approve the works to proceed at this point in time, they will still need to be resolved via a by-law being specially resolved at a general meeting (for the major renovations) and the strata committee will need to formally approve the minor renovations by way of a formal committee meeting. Both of these meetings can be completed electronically, and therefore can reduce the costs associated with holding the meetings.
In response to the emails that have been circulated relating to this matter:
Adam – replacement of kitchen and change of flooring to hard surface flooring is deemed a minor renovation and as such is able to be approved by the committee.
Katherine – your bathroom should have followed the same process if you undertook a full bathroom renovation that included waterproofing, I cannot comment why this was not followed as the legislation and by-laws are very specific.
Matt – There is not a fee to the Strata Committee in order to approve anything. The costs are associated to calling a meeting for the purpose of the works being approved. It is not for just sending an email for consideration/approval to the Strata Committee, as I have mentioned, the committee do not have the authority to approve a bathroom renovation under the legislation.
To provide for clarity as to the reasoning for the by-law, the tiles and waterproofing located on the floor and common walls within a unit are common property. The by-law removes the liability from the Owners Corporation for future repair and maintenance of that bathroom, and specifically for that lot, and as such, should an issue occur with waterproofing in the future, with the by-law in place, it ensures that the Owners Corporation do not need to complete any rectification even in the instance that the unit has been sold from the current owner to a new owner in the meantime.

hi everyone,
Paul Doddrige on level 3 who comes to our meetings sometimes, contacted me a bit distressed because he said Strata title had told him approval for his bathroom reno would cost him $450, as payment to the strata committee.
I'm not sure of the rules, Leanne is that right?
I said to Paul that my kitchen/floor reno was recently approved at no cost.
Does anyone know the history here?
