Hi Katherine,
It's not that simple. A fixture to common property requires a vote of
special resolution at an AGM/EGM. It's not within our power to grant
permission for Adam to do it. Furthermore it would need to be installed
in a professional manner by a company with insurance and the device
would need to meet Australian Standards so that our public liability
remains in force. If someone hurt them self using the equipment and it
was not of professional quality in both manufacture and instillation we
would not have upheld our duty of care.
But finally the government have made it abundantly clear that we should
be self isolating. We should not be sharing gym equipment in any way.
To that end they have introduced an order under the NSW public health
act that has placed an $11,000 fine for a corporate (which we are) and
$1000 for individuals who flaunt that law. The NSW police were out this
morning in the Park at Rushcutters handing out $1000 fines for users of
equipment installed there. Common ares of the building are public spaces
under the law.
There are currently that I know of two owners in the building under
government mandated health orders. One was exposed to a known case on a
flight and the other has returned from a cruse ship. There could be
more that im not aware of.
