To the EC – SP67851:
Further to my email below dated July 18, I attach more pictures of the water which is still dripping through the concrete façade above my terrace, twice ordered by the Tribunal to be repaired.
This is in addition to:
- the water which is dripping down from where the back wall of the planter boxes which meets the metal overhang (which the engineer stated had to have caulking – still not done).
- the water which is dripping through the planter box back wall, onto my terrace
- the water which is still dripping down through the metal overhang outside my apartment, onto my terrace.
- the water which is still dripping into my apartment
Mediation arrangements have been started by me yet again, prior to going to Tribunal for the third time.
Perhaps we have to put a roof over level 7? I’ve been extremely patient about this 10 year plus problem. I request other members of the Body Corporate to respond to the above immediately.

Hello Darren,
I did not receive a copy of the quotes you mentioned below. Again, would you please send me a copy.
Also, I would like to remind the Executive Committee, I have water dripping from level 7 into my apartment. I notified the EC over 10 days ago and Darren visited me to see the dripping water.
What is the delay in these emergency repairs? The Tribunal has twice ordered the EC to complete the water penetration repairs and water is still dripping from the concrete façade above my terrace onto the terrace (in addition to the metal overhang). Two major areas which, if repairs are not made, will cost all owners more eventually.
I understand from an earlier email that there is 120K in the sinking fund available for such repairs. Patrick would you kindly verify that.
I look forward to receiving BIR’s quote. Please also confirm how many quotes we do have Darren and when these can be circulated. I understood there are now three?
Again, let’s get my repairs fixed as soon as possible.

Would you please email me the proposals for each of the contractors as I didn’t receive the last (if there has been an updated) from the first 2 contractors. BIRS’s quote I haven’t received.
The water is still dripping through the concrete façade on the western side of the property onto my terrace, as I showed you Darren.
I look forward to receiving the BIRS proposal and to that end, in line with what the engineer has stated in her report.

I know this has been hard because of unwillingness of contractors to undertake the work. Given we now have at least one firm quote. I think we should go to AGM to raise another special levy. Obviously the budget does not have a spare $70,000. I am happy, given how hard it was to get a quote to proceed on this quote even though we have only one quote as such. Provided the necessary funds are raised.
On the matter of the leaking awning. I believe every awning on the north side suffers these same problems. I believe we should inspect the bolts on all of the awnings on the north face. I have replaced many (more then 5) bolts on my awning holding the sub mesh that have corroded and snapped. There is water ingress through the joints on mine and after rain water is seen dripping from the main bolt observation covers. To that end I think we should include all north facing awnings as a safety issue may be an issue with failure of the awing(s)
To that end i propose at least a 25% buffer on the levy and request $100,000 Daren Perhaps you can ask the contractor for a quote to inspect all north facing awnings including removing the observation covers. Special attention should be given to the louver / mesh attach bolts as when they were originally tightened they appear to be have been over torqued which has damaged the galvanization on the bolts (at least on mine they are ).

Regarding the solution on P4 with cutting the drain. This is what i suggested 3 years ago so yes i agree with that and approve However it's a BMC matter and will require approval from Andrew as well i suggest you put it through Patrick.

Western Terrace Tile Repairs
Building Improvement Restoration Services (BRIS) conducted a site inspection on Tuesday 25th July. They are interested in the repair works including Home Building Warranty Insurance. Part of the works will include addressing the water ingress into the balcony awning structure spanning Apt 601 & 602. We await their works proposal.
It will be good to finally enjoy my terrace again, once the water situation from above is completely repaired. Great also that the tiles on level 7 west will be correctly repaired with joint expansion areas as detailed must happen ( by two of the earlier contractors).
Window Stain Removal
BFMS have provided a quotation to repair a small section of cracked render and hand polish the stains of each section of glass below both podiums. Total - $5,000.00 + GST. Awaiting EC approval to proceed.
You have my approval.

Pooling Water P4
We have managed to get Rescom back onsite and they advised no ground water was identified at the time. We have provided them with additional photo evidence. Awaiting their response.
If we can’t stop the groundwater then the next best option is to catch it and drain it to the stormwater pit. DWRS have provided a quotation to cut a 40mm channel from the base of the entry ramp down to the stormwater pit. Please see the attached for reference. The section in red will have blue metal and the green section will contain a drainage pipe which will be resealed back to a flush finish once installed. Total - $6,500.00 + GST. Please advise if the committee wishes to proceed with this option.
You have my approval to proceed with the new channel cutting asap.

Yes, the damage can’t be patched as per Costin Roe recommendation Options 1 or 2. Cracking of the tile bed has occurred due to water penetration causing movement of the insulation foam beneath the tile bed. Option 3 was to remove all and reinstate new including a recommendation to replace the waterproofing membrane at the same time.
This is only a cost for project Management the final cost is still yet to be determined but likely to be $40 ~ 60k
The cost is for review of the scope of works, tender management of 3 qualified contractors including Pres. Tech (to use as comparison) and contract preparation. Project management is a percentage of the total works sum. Remedial Building have included this in their proposal based on a 70K total works estimate.
Would it be better for us to use Preservation Tech for the final work because of warranty reasons with the existing work?
Definitely, if an issue arises within the warranty period it will be difficult to place the blame with two contractors having worked on the same area.
Looks like cheapest quote is Remedial Building given there management fee is included.

Are we saying we have not been able to find an independent builder and need to use an engineering firm to manage it.
The contractors I have approached are reluctant to take on the work due to the potential warranty issues previously discussed. Pres Tech will only consider the works if an independent consult is engaged to mediate between the two parties.

This matter is for fixing the hogged tiles above 601.
This is only a cost for project Management the final cost is still yet to be determined but likely to be $40 ~ 60k
Would it be better for us to use Preservation Tech for the final work because of warranty reasons with the existing work?
Looks like cheapest quote is Remedial Building given there management fee is included.
Are we saying we have not been able to find a independent builder and need to use a engineering firm to manage it.
