Good morning all

 

Respectfully there is nothing to revoke in respect to illegal practice of
P&S parking in the Wash Bay Area which is in violation of the Commercial
Strata By-Laws.  The arrangement between the previous EC representative (R.
Willett) and BMC representative (A. Veron) was made "ultra vires" and is
therefore a nullity with no legal effect.

 

I again reiterate Clause 21 of the Commercial Strata Plan By-Laws:

 

"21. USE OF VISITOR PARKING AND CAR WASH AREA

 

An owner or occupier of a lot must not use the area designated "Easement for
parking 4 wide" shown on the Basement 3 level of the strata plan except in
accordance with the terms of easement 4 wide numbered 4 in DP 1040255".

 

I support the objection already raised by P. Marston (proprietor of Lots 27
& 47) and his reasons detailed in his email dated 18 August.

 

Perhaps Pia may be able to seek clarification of this point from A. Bull,
solicitor.

Hi All,
 Just a reminder that I need your direction regarding voting on the BMC AGM
also should we revoke P&S's permission to use the wash bay. As we have had
multiple tenant complainants about it.   Meeting is Wednesday.

agenda now and I will run it past you all to get direction on how I 
should vote. Andrew Veron has not responded to any requests for the 
meeting as such we will be holding it without him. This puts me in the 
position to be able to reverse the Pack and Send Parking arrangements. 

Can I get some direction from you all regarding that. You all know I am 
in favor of resending the arrangement.
