No we are free to show someone around the MDF room for a site servery. 
We do plenty of builds without a land access at all. Land access comes 
into play with the strata says no. Which they lawfully can not do. Once 
LA is served it becomes a mater of if it's financial for the carrier to 
pursue the strata to provide access. The fact is this is likely to be 
beneficial to the building. It's like foxtel saying we are coming in and 
giving you pay tv and doing it all for free.  They dont do that of cause 
because they have a monopoly.

There is only a down side with exclusive agreements over the internal 
cable. All carriers have a rite to build in parallel for the external 
cable unless they are using the NBN Act to provide LA. There is word 
that Malcolm Turbull is thinking of altering this but at the moment. 
It's likely fine.

My advice is let them do a site survey. There is no obligation with 
that. Let them make an offer. We will nail them down to makeing ~ $100 
per month for the building. We will license them as long as they build 
within 6 months. (No squatting) and we will insure there is no 
exclusivity. At the moment it's all just commercials and no reason why 
we need to be hostile.

I should point out to the EC  that A company I have a major shareholding 
in is both in direct competition with TPG  and also has a significant 
relationship with Pipe Networks as we use them also for a large amount 
of services. My staff deal with Pipe on a weekly basis and as such there 
is some relationship there. I do not believe this constitutes a conflict 
of interest but it should be made known.
